Small business suppliers have rights under Food and Grocery Code

All small business suppliers to the major grocery stores including Coles, Woolworths and Aldi can now enjoy the full benefits of the Food and Grocery Code of Conduct.

According to the Australian Competition and Consumer Commission (ACCC) a majority of suppliers have chosen to enter code compliant grocery supply agreements (GSAs) with the major supermarket chains.

The Code requires retailers and wholesalers to deal with suppliers in good faith during the bargaining stages of establishing GSAs, during the term of the agreement, and in dealing with any disputes.

Suppliers are reminded that if they haven’t signed a new GSA, they still have protections provided by the Code which overlay their existing terms.

The ACCC will monitor compliance with the Code and if suppliers have any concerns about their dealings with the supermarkets, they should raise them with the ACCC.
