New ‘unfair contract’ laws coming into effect in November 2016, will provide protection for small business in their contracts with larger businesses. The law applies to contracts of less than $300,000 or $1 million if the contract is for more than 12 months.
From November, the Australian Competition and Consumer Commission (ACCC) will be keen to investigate contracts where a small business has been placed at a distinct disadvantage by a larger business. This will include contracts that allow the large business to change terms and conditions without allowing the small business to cancel the contract.
