Attend the mediation in person and be well prepared to make the most of the session as it may be your last opportunity to meet with the other party and try and resolve the matter before litigation.
Come to the mediation session in good faith, be willing to listen to the other party, have an open frame of mind and be prepared to settle the dispute on that day.
Mediators often start by asking each party to tell their side of the story.
Stick to the facts and key issues. Do not get caught up in the minor issues that often arise in disputes.
If you could get the other side to agree to what you wanted, what would it be? Write it down.
Even if your case looks very strong to you, be prepared to accept that there may be potential weaknesses.
Disputes are rarely black and white.
What is the limit of what you can really afford to accept?
Think about other options of settling the dispute and be ready to discuss them.
What are you prepared to compromise in order to resolve the dispute?
Would you be able to offer part of what they want in order to reach a compromise?
Any supporting documents you have submitted with your application.
Any notes you have made such as your short statement, the outcome you'd like, other options etc.
Dress neatly and professionally as you would for a business meeting - you do not need formal clothes.
Arrive early - about 15 minutes before the mediation session starts.
Tell staff at the SBDC Information Centre that you have arrived. Tell them the name of your case manager.
